Marketplacer Community Privacy Notice

Our Terms of Service for either sellers or operators (based on whether you are a seller or an operator, as those terms are defined) govern your participation in Marketplacer’s community of sellers and marketplace operators (our Community) and should be read together with this notice.

This notice explains how Marketplacer will collect your personal data if you participate in Community, and how we use, share, store and retain your personal data. Personal data means any information relating to an identified or identifiable natural person. 

Marketplacer’s platform supports its customers (known as “operators”) to manage an online marketplace. 

In this policy, we, us, our or Marketplacer refers to the Marketplacer group of companies which includes Marketplacer Holdings Limited, a corporation registered in Australia, and its subsidiaries located in the United States, Australia, the United Kingdom and New Zealand.

1. Our collection of personal data

This notice does not apply to information we collect about businesses or companies, however it does apply to information we process about the people in those businesses or companies. 

Information collected directly from you

The personal data we collect directly from you will generally be apparent from the context in which you provide the information. In particular, when you register for Community and create an account, we collect your first and last name, email address, phone number and information about your business, as well as account credentials such as your username, passwords and similar security information used for authentication and account access.

Data created through use of Community

Community is hosted on our Site, so when you visit Community, we also collect and use information about you in accordance with our Website Privacy Policy. The Policy provides important information about our collection, use and storage of your information so please read it together with this notice. 

Marketplacer may combine the data collected from these sources with other data in its possession. Marketplacer will de-identify or destroy personal data when no longer required by us, subject to our legal retention requirements and standard business continuity procedures.

2. How we use personal data

We rely upon a number of legal grounds as outlined in this section to ensure that our use of your personal data is compliant with applicable law.

Contractual and pre-contractual business relationships.

We use your personal data for the purpose of performing our contractual obligations under our Terms of Service.  Activities that we conduct in this context include creation and management of registrations and maintenance of our directory and user credentials.

Legitimate interests.

When we process your data on the basis of legitimate business interests, we take measures and ensure safeguards are in place to protect your rights and interests. Specifically, we process personal data to:

  1. To check your identity and prevent fraud and misuse.
  2. To provide and administer the Community, including maintaining a directory of sellers and operators and advertising in various media.
  3. To identify opportunities to help improve, and to then improve, our services and technologies.

Consent.

If you consent, we may process your data or share it with third parties for the purposes of marketing, advertising and related analytics as detailed in our Website Privacy Policy

If our data collection or processing is based on your consent, you may at any time withdraw your consent with effect for the future by email to privacy@marketplacer.com. 

Complying with legal obligations.

In limited circumstances, we may need to process your personal data in order to comply with our financial, regulatory and other legal obligations.

3. Who Marketplacer shares personal data with

Community participants – sellers

If you are a seller, when you join Community, you authorize us to notify you by email when an operator requests a connection with you in order to discuss your business selling products on its marketplace. We will not share the information you provide to us with other participants in the Community and you will have the opportunity to reject or accept the connection request. 

Community participants – operators

If you are an operator, when you join Community, you authorize us to notify you by email when a seller responds to a connection request you make. We will not share the information you provide to us with other participants in the Community.

Service Providers.

We may share your information with a limited number of third party service providers who we engage to perform tasks or provide capabilities on our behalf. 

The organizations that Marketplacer shares personal data with are located throughout the world, but predominantly in the United States, European Union and Australia. If you are in the European Union, some of the countries to which data will be transferred in our use of service providers, such as the United States and Australia, may not necessarily have data protection laws as comprehensive or protective as those in your country of residence. Marketplacer has adopted internal policies and implemented measures to ensure appropriate and suitable safeguards are in place in relation to such transfers. Advertising

If you consent, third party ad networks (such as Google and Facebook) may store cookies in your browser when you use our Services.  Please refer to our Cookies Policy for more information. 

4. Your rights and choices

Depending on your location and subject to applicable laws, you may have the following rights with regard to the person data we control about you:

  1. The right to request access to and rectification of personal data relating to you.
  2. The right to request that we erase your personal data in certain circumstances provided by law.
  3. The right to request that we restrict our use of your personal data in certain circumstances, such as while we consider another request that you have submitted.
  4. Where the processing of your personal data is based on your previously given consent, you have the right to withdraw your consent at any time.
  5. The right to object to the processing of your personal data for direct marketing purposes or on grounds relating to your particular situation.

You can exercise the above rights by contacting us at privacy@marketplacer.com. You also have the right to lodge a complaint with your local supervisory authority, which will vary depending on your location. 

You can elect to withdraw from your participation in Community at any time by providing written notice to community@marketplacer.com.

5. How to contact us

If your principal place of business is in the United States of America, Marketplacer means Marketplacer LLC, a Delaware corporation. If your principal place of business is in the United Kingdom or Europe, Marketplacer means Marketplacer (UK) Limited. If your principal place of business is anywhere other than the United States of America, the United Kingdom or Europe, Marketplacer means Marketplacer Pty Ltd, an Australian registered business.
