Marketplacer Community Pilot Privacy Notice

This pilot is a small-scale, limited-feature offering of Marketplacer’s community of sellers and marketplace operators (our Community). Our terms of service govern your participation in the pilot and should be read together with this notice.

This notice explains how Marketplacer will collect your personal data if you register to participate in Community, and how we use, share, store and retain your personal data. Personal data means any information relating to an identified or identifiable natural person.

If your principal place of business is in the United States of America, Marketplacer means Marketplacer LLC, a Delaware corporation. If your principal place of business is anywhere other than the United States of America, Marketplacer means Marketplacer Pty Ltd, an Australian registered business.

2. Our collection of personal data

This notice does not apply to information we collect about businesses or companies, however it does apply to information we process about the people in those businesses or companies.

Information collected directly from you

The personal data we collect directly from you will generally be apparent from the context in which you provide the information. In particular, when you register for Community and create an account, we collect your first and last name, email address, phone number and information about your business, as well as account credentials such as your username, passwords and similar security information used for authentication and account access.

Data created through use of Community

Community is hosted on our Site, so when you visit Community, we also collect and use information about you in accordance with our Website Privacy Policy. The Policy provides important information about our collection, use and storage of your information so please read it together with this notice.

Marketplacer may combine the data collected from these sources with other data in its possession. Marketplacer will de-identify or destroy personal data when no longer required by us, subject to our legal retention requirements and standard business continuity procedures.

3. How we use personal data

We rely upon a number of legal grounds as outlined in this section to ensure that our use of your personal data is compliant with applicable law.

Contractual and pre-contractual business relationships.

We use your personal data for the purpose of performing our contractual obligations under our Terms of Service. Activities that we conduct in this context include creation and management of registrations and maintenance of our directory and user credentials.

Legitimate interests.

When we process your data on the basis of legitimate business interests, we take measures and ensure safeguards are in place to protect your rights and interests. Specifically, we process personal data to:

  • To check your identity and prevent fraud and misuse.
  • To provide and administer the Community, including maintaining a directory of sellers and operators and advertising in various media.
  • To identify opportunities to help improve, and to then improve, our services and technologies.
  • For direct marketing where you have expressed an interest in a business relationship, but only if we think you are able to reasonably expect at the time and in the context of collection of the data that processing for the purpose of direct marketing may take place. We do this in the interest of growing Marketplacer’s business.

Consent

a. If you consent, we may process your data or share it with third parties for the purposes of marketing, advertising and related analytics as detailed in our Website Privacy Policy.
If our data collection or processing is based on your consent, you may at any time withdraw your consent with effect for the future by email to privacy@Marketplacer.com.

Complying with legal obligations.

In limited circumstances, we may need to process your personal data in order to comply with our financial, regulatory and other legal obligations.

4.Who Marketplacer shares personal data with

Community participants.

When you join Community, you authorize us to share the information you provide to us with other participants in the Community (including your business name, description of business, name, email address and phone number).

Service Providers.

We may share your information with a limited number of third party service providers who we engage to perform tasks or provide capabilities on our behalf. These companies include (for example) analytics providers like Google Analytics and our database hosting service Amazon Web Services.

The organizations that Marketplacer shares personal data with are located throughout the world, but predominantly in the United States, European Union and Australia. If you are in the European Union, some of the countries to which data will be transferred in our use of service providers, such as the United States and Australia, may not necessarily have data protection laws as comprehensive or protective as those in your country of residence. Marketplacer has adopted internal policies and implemented measures to ensure appropriate and suitable safeguards are in place in relation to such transfers. Advertising

If you consent, third party ad networks (such as Google and Facebook) may store cookies in your browser when you use our Services. Please refer to our Cookies Policy for more information.

5. Your rights and choices

Depending on your location and subject to applicable laws, you may have the following rights with regard to the person data we control about you:

  • The right to request access to and rectification of personal data relating to you.
  • The right to request that we erase your personal data in certain circumstances provided by law.
  • The right to request that we restrict our use of your personal data in certain circumstances, such as while we consider another request that you have submitted.
  • Where the processing of your personal data is based on your previously given consent, you have the right to withdraw your consent at any time.
  • The right to object to the processing of your personal data for direct marketing purposes or on grounds relating to your particular situation.
